General Statement of Privacy
New Democracy is a 501(c)(4) social welfare organization, working to support pragmatic Democratic leaders – governors, mayors, state officials and Members of Congress – with the mission of expanding the party’s appeal across Middle America and make Democrats competitive everywhere. We respect the privacy of those who visit our Site (https://www.newdemocracy.net). By accessing the Site, you are consenting to the information collection and use practices described in this Privacy Policy.
Personally Identifiable Information
Personally Identifiable Information (“PII”) includes, but is not limited to your email address, mailing address, telephone number, and zip code. A user’s PII is collected through online forms, email registration, and event registrations. We do not collect PII about you on the Site without your knowledge or action. However, if you disclose any information on an open forum that is hosted by us, others may collect that information to send you unsolicited information from outside our organization, or for other purposes. Except as otherwise described herein, the PII you provide on the Site will not be shared outside of our organization without your permission.
Use of Personally Identifiable Information
The PII you supply us with will be used to provide you with more effective customer service, improve the Site and other products, and provide you with relevant information. We will only share data for that purpose to our employees, staff, and partners. If we contract with a third party to act on our behalf, we will only provide them with as much information as needed to provide services and will require they comport with the restrictions of our privacy policy. We will never sell your email address or other PII.
Non-Personally Identifiable Information
Non-PII includes, but is not limited to, information we automatically collect on the use and/or actions on our Site (e.g., user traffic patterns, page views on the Site, click-through rates, and search terms that users enter into our search utility). In addition, when a visitor arrives at our site, we collect the IP address, operating system, and browser software used. An IP address (which is not the same as an email address) can tell us the user’s internet service provider and, based on that, is used to provide an approximate geographic location of the connection.
As a general matter, we do not collect demographic information about you through regular use of the Site. However, in recognition of the sensitive nature of such information, in the event we come into possession of such information, whether through your voluntary submission of such information in response to a special feature on the Site or by receiving such information from any of our business partners, such information shall, when coupled with any of your PII, itself be deemed to be PII and treated by us as such.
Use of Non-PII
As a general matter, Non-PII helps us determine how the Site is being used, helps us identify popular areas of the Site, and helps determine the effectiveness of our promotional activities regarding the Site. In the course of collecting, non-PII may be shared with third parties.
Use of Cookies
The Site uses cookies to help track your usage of our site, including what advertising you have seen. The Site’s cookies enable us to provide you with services you may request. You can refuse our cookies by turning them off in your browser (for more information on how to do this, please refer to your browser’s documentation). You do not need to have cookies turned on in your browser to use the Site; however, without cookies certain of the automated functions and features of the site will not be available to you. We also use cookies to measure the click through rate on emails delivered.
Do Not Track
We respect user choice and controls. To the extent possible, the Site responds to Do Not Track (“DNT”) signals communicated by your browser. However, there is currently no DNT industry standard defined and therefore we cannot guarantee that we will respond to the DNT signal on your browser.
Third-Party Websites
We may post links to third party websites on our Site. These third party websites are not screened for privacy or security issues by us, and you release us from any liability for the conduct of these third-party websites. Please be aware that this Privacy Policy, and any other policies in place, in addition to any amendments, does not create rights enforceable by third-parties or require disclosure of any personal information. We bear no responsibility for the information collected or used by any advertiser or third-party website. Third-Party Access to your Information
Although you are entering into an Agreement with us to disclose your information to us, we do use third-party individuals and organizations to assist us, including contractors, web hosts, and others.
Throughout the course of our provision of our service to you, we may delegate our authority to collect, access, use, and disseminate your information. For example, our web host stores the information that you provide us, and we may hire outside contractors to perform maintenance or assist us in securing our Site.
It is therefore necessary that you grant the third parties we may use in the course of our business the same rights that you afford us under this Privacy Policy. For this reason, you hereby agree that for every authorization which you grant to us in this Privacy Policy, you also grant to any third party that we may hire, contract, or otherwise retain the services of for the purpose of operating, maintaining, repairing, or otherwise improving or preserving our Site or its underlying files or systems. You agree not to hold us liable for the actions of any of these third parties, even if we would normally be held vicariously liable for their actions, and that you must take legal action against them directly should they commit any tort or other actionable wrong against you.
Release of your Information for Legal Purposes
At times it may become necessary or desirable, for legal purposes, to release your information in response to a request from a government agency or a private litigant. You agree that we may disclose your information to a third-party where we believe, in good faith, that it is desirable to do so for the purposes of a civil action, criminal investigation, or other legal matter. In the event that we receive a subpoena affecting your privacy, we may elect to notify you to give you an opportunity to file a motion to quash the subpoena, or we may attempt to quash it ourselves, but we are not obligated to do either. We may also proactively report you, and release your information to, third-parties where we believe that it is prudent to do so for legal reasons, such as our belief that you have engaged in illegal or fraudulent activities. You release us from any damages that may arise from or relate to the release of your information to a request from law enforcement agencies or private litigants.
Commercial and Non-Commercial Communications
By providing information to the Site that forms the basis of communications with you, such as contact information, you waive all rights to file complaints concerning unsolicited emails from us since, by providing such information, you agree to receive communications from us or anyone else covered under this Privacy Policy. However, you may unsubscribe from certain communications by notifying us that you no longer wish to receive solicitations or information and we will endeavor to remove you from the database.
Security Measures
We take certain measures to enhance the security of our Site, including using SSL certificates and vulnerability scanning. However, we make no representations as to the security or privacy of your information. It is in our interest to keep our Site secure, but we recommend that you use anti-virus software, firewalls, and other precautions to protect yourself from security threats.
Your California Privacy Rights
We permit residents of the State of California to use our Site. Therefore, it is our intent to comply with the California Business and Professions Code §§ 22575-22579. If you are a California resident you may request certain information regarding our disclosure of personal information to any third-parties for their direct marketing purposes. International Transfers
Your information may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, we transfer personal information to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
Notice to Parents or Guardians
We want to help you protect your child’s privacy. We encourage you to talk to your children about safe and responsible use of their personal information while using the Internet. We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for our services or send any information about yourself, including your name, address, telephone number, or email address, to us. No one under age 13 may provide any personal information to or on the Site or us. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will make commercially reasonable efforts to delete such information from our database as quickly as possible. Data Retention
You may write us at any time if you wish to cancel your account or have us remove your PII from our database. We collect and retain data for the purposes stated on this website and described in the Privacy Policy and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Governing Law
This Privacy Policy and our privacy practices, as well as any dispute arising out of or relating thereto, will be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within the District of Columbia to resolve any legal matter arising from this Privacy Policy and our privacy practices. Notwithstanding the foregoing, you agree that we shall be allowed to apply for injunctive relief (or an equivalent type of urgent legal relief) in any jurisdiction. We make no representation that this Privacy Policy and such practices comply with the laws of any other country. Visitors who use the Site and reside outside of the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
